Décret n° 2-14-85 du 28 rabii I 1436 (20 janvier 2015) relatif à la gestion des déchets dangereux

Ce décret organise la gestion des déchets dangereux en application de la loi n° 28-00 : organisation interne chez les producteurs, collecte et transport, puis stockage et traitement. Art. 1er

Chaque producteur tient un registre des déchets dangereux (quantité, type, nature, origine et destination), conservé cinq ans et tenu à la disposition des agents de contrôle. Art. 5

Il adresse chaque année, avant le 1er avril, un rapport sur les déchets de l'année précédente à l'autorité chargée de l'environnement. Art. 6

Obligations principales
  • Art. 5Tenir un registre des déchets dangereux indiquant la quantité, le type, la nature, l'origine et la destination des déchets, selon le modèle fixé par arrêté, et en conserver les informations cinq ans à la disposition des agents de contrôle.
    Le registre prévu à l’article 37 de la loi n° 28-00 précitée est tenu par le générateur, le détenteur, le collecteur-transporteur et l’exploitant de l’installation de stockage ou de traitement en vue de l’élimination ou de la valorisation des déchets dangereux, selon le modèle fixé par arrêté de l’autorité gouvernementale chargée de l’environnement.

  • Art. 6Transmettre chaque année à l'autorité gouvernementale chargée de l'environnement un rapport sur les quantités, le type, la nature, l'origine et la destination des déchets dangereux de l'année précédente.
  • Art. 8Désigner parmi le personnel une personne chargée de la gestion des déchets dangereux, dénommée « responsable déchets ».

Les sites qui produisent des déchets dangereux doivent tenir un registre des déchets dangereux (quantité, type, origine, destination — art. 5), transmettre chaque année, avant le 1er avril, le rapport sur les déchets de l’année précédente (art. 6), établir et actualiser un plan interne de gestion des déchets dangereux (art. 7) et désigner un « responsable déchets » (art. 8).
